Will the Obama administration allow a transgender-bathroom compromise?

We have a local test case in the bathroom wars, and the reaction from the aggressors will be telling.

The “guidance” on transgender students’ bathroom choices issued by the Obama administration on Friday is an unenforceable torching of the separation of powers that is best understood as an election-year ploy, a wedge issue to drive turnout of a Democratic base that’s moved to the left faster than Hillary Clinton anticipated. One of the many reasons this is particularly irresponsible is that it places local education officials in the hopeless position of trying to please two implacable constituencies. So much for just letting teachers do their jobs.

Georgia’s largest school district, Gwinnett County, has set its course for navigating these possibly unnavigable waters. The district’s entire statement is worth reading, including the correct observation that either Congress or the courts will have to act before this issue is actually resolved. But here’s the operative part:

“We believe our current practice is reasonable, logical, and workable, and therefore, it should not be uprooted by what we consider an overreach by two federal agencies. After carefully considering the issue, GCPS will continue to provide students with sex-designated restroom facilities, while offering gender-neutral facilities to any student who does not wish to use the restroom facility designated for his or her biological sex.”

The only people who should object to that policy are interested in scoring points. There is an option to suit everyone’s comfort level. There’s no coercion. At least, there’s no coercion by the school system; will there be coercion by the Obama administration?

If there is — not that any court should uphold a withholding of duly appropriated funds — it will simply be to push the most politically aggressive stance possible. It won’t be to serve the best interests of students, transgender or not. It will be, like so much else that’s wrong with education, to push the agendas of some adults.

To think that any school aged child, with maybe an exception for high school students, has the mental capacity or is mature enough to make a decision on gender identity or sexual orientation is pathetic. Kids are supposed to go to school to get an education, not be indoctrinated!

@Darken-Rahl If the 0.3% figure is to be believed, that translates to a total of 3 "transgender" students in a school of 1000 kids.  So, in order to make those 3 "confused" students feel better, 500 girls are going to feel nervous about using the restroom.

Brilliant solution, Libs.

Transexuals vs transgenders.

If transgenders are fully committed to their preferred identity then let THEM commit fully through sexual reassignment surgery...

then they can enter the bathroom with appropriate plumbing.

The vast majority of transgenders choose not to have the surgery for purely "selfish" reasons. Because it would diminish their personal pleasure thereby rendering them "unhappy"... unfulfilled.

Long-Term Follow-Up of Transsexual Persons Undergoing Sex Reassignment Surgery: Cohort Study in Sweden

Conclusion?

This study found substantially higher rates of overall mortality, death from cardiovascular disease and suicide, suicide attempts, and psychiatric hospitalisations in sex-reassigned transsexual individuals compared to a healthy control population. This highlights that post surgical transsexuals are a risk group that need long-term psychiatric and somatic follow-up. Even though surgery and hormonal therapy alleviates gender dysphoria, it is apparently not sufficient to remedy the high rates of morbidity and mortality found among transsexual persons. Improved care for the transsexual group after the sex reassignment should therefore be considered.

JFK wouldn't be welcome in today's Democrat party.  He wasn't an insane freak using wedge issues to attack religion, normal family values, personal responsibility, due process, national sovereignty, and traditional American beliefs.

Ummm. Its conservatives who are hoping to use this as a wedge issue. This is what they do.

Spread fear that a child will be molested by someone transgender in a bathroom

When in fact they are far more likely to be molested by a family member or say a Catholic priest.

@Hedley_Lammar

Nonsense.  Conservatives were minding their own business until the nutjob left started passing laws forcing their bizarre beliefs on others.

@Hedley_Lammar Very few people are worried about a "true" transgender person using the bathroom.  Most people are more concerned about the "Unintended Consequences" of heterosexual men claiming a right to change clothes with little girls.  There are already a few cases on the books.

Pssst. Men dressed as women have been using the women's restroom for a long long time.

@Hedley_Lammar So, are you going to acknowledge the real concern people have, or are you going to keep playing stupid??

So this is their new line in the sand.

Sad really

Another case in NYC in which a man walked in and used the girls locker room with impunity:

http://time.com/4324687/even-in-liberal-communities-transgender-bathroom-laws-worry-parents/

"According to one mother of a swim team member, Ellen Vandevort, her daughter was just leaving the locker room in late April when a person who was bald, with heavy stubble and a towel at waist level, stepped out of the shower. Her daughter and the younger girls on the team, says Vandevort, grew alarmed and reported it to the swim coach who suggested that the girls change in the family shower room.

An employee at the center who spoke on condition of anonymity says the individual using the locker room appears to present as a man—wearing swim shorts or trunks to swim, with sideburns going down into a beard—which is partly what alarms the girls and their parents. Staff members have also been warned that asking individuals to prove their gender identity would be discriminatory. “Our hands are tied,” the worker said.”We can’t say anything about it.”

So, basically, young girls are now afraid to use the locker room across America.  Way to go, Libs.

Hedley_Lammar

@Bruno2 He would have gone in there with or without any law changes

Do you really think someone so depraved would have cared ?

Flashers etc have been around FOREVER

Bruno2

@Hedley_Lammar @Bruno2 Under the old, sensible laws, that flasher would be arrested and subject to prosecution.  Now, there is no penalty.  Are you really too dense to see that??

EXACTLY!

There will, however, be LGBT advocates who see gender-neutral accommodations as exclusive rather than inclusive...

as segregating transgenders rather than desegregating.

If transgenders reject gender-neutral bathrooms on THOSE points, they'll lose.

Newton's third law of motion cannot be denied.

Strange how the Cons have no concern about women pretending to be men showering in the men's locker room. why is that?

JohnnyReb
JohnnyReb

@lvg to state no concern is pure bunk, but it is true the bigger concern is for women, specifically young girls in school.

Perhaps our concern for women is genuine vs the fake concerns of the Left?

How do I prove the Left's concern for women is fake?

Look no further than the Left's howling about Muslim immigrants.

No religion/people discriminate more against women than Muslims, yet the Left wants more in our country regardless of them being vetted.

And don't fool yourself, there is a big difference between a Muslim born and reared in the USA vs one born and reared in a Muslim country.

They don't assimilate.

@lvg Do you not have any idea of crime stats, or even basic biology??

Frankly, I think this bathroom issue exposes Libs for what they are, and it's not too cool.

Here's a piece from RCP speculating on how a Repub president will handle Obama's executive ruling assault on Environmental Rights.

It's an easy jump to how, hopefully Trump will handle other Obama dictates including the bathroom edict which has no practical answer at schools other than spending a lot of money for separate bathrooms/showers.

The main point here being any third party run on the Right or Hillary winning out right will be more of the ridiculous direction down the pooper.

Obama's compromise: Do as you're told, and government agents won't do to you, in a legal sense, what the faux women want to do to little girls in the bathroom.

RafeHollister
RafeHollister

Three bathrooms, setters, pointers, and undecided, should be a simple solution.  Each school designate one bathroom for the undecided.

States and counties should decide how they want to go and just do it.  Obama's order carries no weight, just a lame duck loser looking to stir the pudding for his successor.  No way Congress will ever pass legislation forcing people to accept someone of the opposite sex into the shower with them.

Lil_Barry_Bailout
Lil_Barry_Bailout

The people who support Obama are the losers--they've lost the ability or the will to govern themselves and now rely on a petulant p-u-t-z to do it for them.

JohnnyReb

Where to relieve ones self does not appear to be the biggest issue.

Both men and women bathrooms have stalls.

The bigger issue appears to be not public or school bathrooms but locker rooms/showers.

Even liberal parents are likely to object to a girls locker room shower at school being invaded by a body who was born a boy and still has his boy part even though he now thinks he should have been a girl.

And to complicate the issue, what are the odds of a boy with gender identity issues being bisexual?

This is an issue the Left has taken too far and my sincere wish is there is such an uproar they have to publicly do a reverse.

DaltonbywayofBickley
DaltonbywayofBickley

@JohnnyReb Actually, this is a right issue, that wasn't an issue. Totally, a reaction to the marriage equality ruling of SCOTUS, as was the bill Deal vetoed.

Wascatlady
Wascatlady

Providing a flexible bathroom seems like a solution, but the complication is providing enough of these.  At school, there is limited time to use the bathroom, and I can imagine a line for this type facility being long, not for the transgender students, but for those who prefer privacy for various reasons.  I don't think you can put a sign saying "transgender only" as that just calls to attention that status.

Kyle_Wingfield
Kyle_Wingfield moderator

@Wascatlady Genuinely curious here: Do you really think there'd be that much demand for such a restroom?

JFMcNamara
JFMcNamara

I wish we hadn't turned this into an issue. It wasn't one, and we had no actual reason to make it one, given there were no actual complaints.  Just go into a stall and close the door if you are uncomfortable.

Now, its an inconsequential culture war meant to upset voters on both sides to drive votes.  Way to go America!

Lil_Barry_Bailout
Lil_Barry_Bailout

@JFMcNamara @Lil_Barry_Bailout

False.  The Charlotte ordinance started it, at least in that instance.  There were other locales that have made it legal for men to use women's restrooms.  I'm not aware of any laws passed that do the opposite.  It wasn't necessary until sex-obsessed leftists went insane.

Aquagirl
Aquagirl

@Lil_Barry_Bailout If the duly elected representatives in Charlotte decided on this policy, why aren't you small gub'mint worshipers on their side?

The state sticking it's nose into local business is fine by you, but when the feds do it it's godless commie leftist overreach.

Lil_Barry_Bailout
Lil_Barry_Bailout

Because no government, regardless of how small or local, gets to violate our rights.

And according to you leftists, privacy is a right, remember?

Aquagirl
Aquagirl

@Lil_Barry_Bailout People still have a right to privacy, if it's violated by peeping (or worse) the law gets involved. Nothing has changed except the massive pearl clutching from primarily men, who are convinced this will lead to a parade of cross-dressing perverts assaulting helpless women and girls.

I wonder why these mens' minds go there so quickly?

Lil_Barry_Bailout
Lil_Barry_Bailout

@Aquagirl @Lil_Barry_Bailout

Yes, people have a right to privacy.  And there are reasons why we have separate men's and women's restrooms, and one of those reasons is privacy and simple decency.

Lil_Barry_Bailout
Lil_Barry_Bailout

@JFMcNamara

Leftists started this for a reason.  Kyle nailed it.

Most Americans are pretty tolerant of things they oppose on moral grounds or out of a sense of decency.

Until you purposefully start rubbing their noses in it for no good reason.  Then you might get some pushback.

Don't bet on them being reasonable and accepting such a logical solution that meets everyone's needs, Kyle.  Its about proving they are right and anyone who doesn't agree with them is a bigot who must be silenced.  They are almost scary enough to make me vote for Trump.  Naahhh!
